بازخوانی اندیشه‌های فلسفۀ حقوق کانت با رویکردی بر مفاهیم کاربردی معاصر

چکیده
ایمانوئل کانت - فیلسوف برجسته دوران روشنگری - تأثیر عمیقی بر نظام‌های حقوقی و سیاسی مدرن گذاشت. این پژوهش با رویکرد توصیفی - ‌تحلیلی، به بررسی ابعاد مختلف فلسفه حقوق کانت می‌پردازد و نشان می‌دهد مفاهیم بنیادینی چون آزادی، عدالت، خودمختاری و مسئولیت فردی در اندیشه او، مبنای شکل‌گیری اصول حقوق طبیعی، سیاسی و بین‌المللی هستند. فلسفه سیاسی و حقوقی کانت، از اخلاق فردی فراتر می‌رود و در نظم مدنی و جهانی نیز توسعه‌دادنی است. او قانون سیاسی را ابزاری می‌داند برای تضمین آزادی فردی در چارچوب نظمی عقلانی که بر برابری و حاکمیت قانون استوار است. همچنین حقوق جهان‌وطنی در نظر کانت نه‌تنها مفهومی اخلاقی، بلکه راهکاری عملی برای تحقق صلح پایدار در عرصه بین‌الملل است؛ صلحی که بر عقل عملی و کرامت انسان مبتنی است. این پژوهش تأکید دارد با بررسی آموزه‌های کانت، می‌توان چارچوبی نظری و کاربردی برای حل بسیاری از چالش‌های حقوقی امروز به ‌دست آورد و نیز از اندیشه‌های او می‌توان در تدوین قوانین و نظام‌های حقوقی منطبق بر عدالت جهانی بهره گرفت.

چکیده English

Immanuel Kant — the eminent Enlightenment philosopher — exerted a profound influence on modern legal and political systems. Employing a descriptive-analytical approach, this study examines various dimensions of Kant's legal philosophy, demonstrating how foundational concepts such as freedom, justice, autonomy, and individual responsibility in his thought form the basis for natural law, political law, and international law. Kant's political and legal philosophy extends beyond individual ethics and is expandable to civil and global order. He views political law as an instrument to guarantee individual freedom within a framework of rational order grounded in equality and the rule of law. Furthermore, Kant's notion of cosmopolitan law (jus cosmopoliticum) is not merely an ethical concept but a practical solution for achieving lasting peace in the international arena — a peace founded on practical reason and human dignity. This research emphasizes that by analyzing Kant's doctrines, we can derive a theoretical and practical framework for addressing many contemporary legal challenges. His ideas remain instrumental in formulating legal systems aligned with global justice.
